Personal Injury Attorneys

A person who suffers a loss or has been injured in some way due to the negligence or actions of another has recourse under the law in the U.S. if he can prove that financial or physical loss he has suffered was the fault of another person or organization, he can approach a personal injury attorney to seek compensatory and punitive damages on his behalf. for instance, if he is in a car accident caused by a drunk driver and is injured or disabled in the process, he can seek compensation from the other driver. Personal injury law, also known as tort law, covers claims arising from a wide range of situations such as wrongful death, medical malpractice, and defective products to accidents, discrimination, and worker’s compensation. A victim can make a claim for loss of income arising from physical disability or emotional distress or for damage to property. A qualified personal injury attorney will help a plaintiff file a proper case and secure fair compensation for the loss or injury. Usually, such attorneys charge contingency fees, payable only after damages have been recovered. A personal injury attorney must be chosen carefully, based on his experience with similar cases and his success rate. make sure you choose one who has had experience dealing with insurance companies that most often represent defendants in personal injury cases. An experienced personal injury attorney will settle a claim out of court, as most defendants want to avoid publicity and costly trials. if a case does go to court, a skilled attorney will be able to provide persuasive evidence in your favor and secure the best compensation possible. while there is no minimum or maximum settlement, it will depend on the actual nature of the loss or injury and how long the effects are expected to last. If you are the victim of a physical injury or have suffered a health loss, income loss, or loss of property or reputation due to the negligence or malicious intent of another, contact a reputed personal injury attorney and claim appropriate compensation. The law allows you to do so. EWG highlights this epidemic: The highly politicized controversy in Washington over asbestos litigation has overshadowed a quiet and directly related crisis in public health: an epidemic of asbestos-caused diseases in the United States that claims the life of one out of every 125 American men who die over the age of 50 . Based on the latency period for asbestos illnesses to develop EWG believes the mortality rate will increase for the next ten years and peak in by 2014 when “there will be 3,776 deaths from mesothelioma and 2,536 deaths from asbestosis reported to the federal government.” Posts Related to Asbestos illness epidemic WHO Says Mesothelioma Still Rising, According to Surviving Mesothelioma (PRWEB) December 01, 2011 Surviving Mesothelioma reports that the incidence of mesothelioma and the number of countries whose citizens are dying of this disease are … More Mesothelioma Deaths among Iron Range Workers Duluth, Minnesota – a team of public health professors from the University of Minnesota, who are tracking mesothelioma-caused deaths among taconite workers who toiled on … Rising Tide of Asbestos Disease Projected in South Korea During 21st Century The  number of people dying of mesothelioma is near its peak in the United States. Asbestos exemption to ‘no-win, no-fee’ changes

24 April 2012 Last updated at 16:59 ET Share this page Mesothelioma is a form of cancer which can take decades to develop Sufferers of asbestos-related cancer will initially be exempt from government changes to “no-win, no-fee” rules, a justice minister has said. Jonathan Djanogly said there would first be a review of the changes, which will see successful claimants pay part of their damages to their solicitors. Peers and campaigners say mesothelioma victims should be exempt because the illness's severity is indisputable. The government says the changes are designed to deter spurious claims. Mesothelioma is a rare form of cancer that can take decades to develop. Most sufferers came into contact with asbestos during the course of their work – for example, plumbers and teachers who encountered the material in 1960s schools. ‘Careful reflection’ The changes to no-win, no-fee in England and Wales – contained in the Legal Aid, Sentencing and Punishment of Offenders Bill – will prevent lawyers claiming “success fees” from the losing side. Instead, it will see them receive a share of the compensation given to their own client – up to a maximum of 25% of the total pay-out. Mr Djanogly said there had been “careful reflection about the special case of mesothelioma sufferers”, and a delay would now be imposed. He also said the government was looking at ways of making it easier for sufferers and their solicitors to trace their former employer's insurers. He told the Commons: “the government is committed to action on this point. “We are working closely with insurers and other stakeholders on this pressing issue, with a view to making an announcement on this issue by this July.” Shadow justice secretary Sadiq Khan welcomed the concession: “the key question here is should victims of industrial diseases like mesothelioma have to hand over part of their damages to their lawyers and insurer, or should the wrongdoers fund the cost of the successful litigation? “Someone suffering this horrible disease is not making up their cancer to make a quick buck. they cannot possibly be part of the compensation culture.” Conservative MP Tracey Crouch also welcomed the move, saying: “it is not right to put victims of an extraordinary disease, where no fraud is possible and compensation is certain, into a situation where in their last few months of life they are being forced to shop around for a lawyer in order to pay the least amount of success fees.” Posts Related to Asbestos exemption to 'no-win, no-fee' changes Government overturns Lords justice reforms changes The Government has made a U-turn on its justice reforms by making it easier for the victims of domestic violence to claim legal aid.But it … Asbestos: court ruling opens way for insurance claims 28 March 2012 Last updated at 09:43 ET Share this page Mesothelioma is a form of cancer which can take decades to develop The UK … Asbestos relatives win right to compensation 7:50pm, Wed 28 Mar 2012 Asbestos relatives win ruling – last updated Wed 28 Mar 2012 Thousands of relatives of industrial workers will get compensation … Legislation due on asbestos-related pleural plaques 5 December 2011 Last updated at 08:14 ET Share this page Pleural plaques causes a thickening of lung membranes People suffering from the asbestos-related lung … Next in the queue 20 March 2012 last updated at 12:52 ET Share this page Thanks to pretty solid Liberal Democrat support, the Health and Social Care bill has …
